Terms of Use

1. Scope of Application

These Terms apply to browsing this site, using its information, inquiries, brochure requests, consultations, applications and any other use of this site. These Terms do not set the contract conditions of the vacation rental and lodging facility management services or other paid services that we provide. If we and a user agree on conditions for an individual service by contract, application form, quotation, order details, email or any other method (such an agreement is referred to below as an “Individual Contract”), the Individual Contract applies to that service. If these Terms and an Individual Contract differ, the Individual Contract prevails. Making an inquiry, brochure request, consultation or quotation request on this site does not, by itself, form a contract with us for any paid service.

2. Use of This Site

Users must prepare, at their own responsibility and expense, the devices, communication equipment, communication lines, software and other environment needed to use this site. Users bear communication charges and other costs incurred in using this site. We may limit the regions, devices, browsers and other environments in which this site can be used. Users must use this site in compliance with these Terms, laws and regulations, and public order and morals.

3. Prohibited Acts

When using this site, users must not do any of the following.

• Acts that violate laws, ordinances, public order and morals, or these Terms
• Acts related to criminal activity or that encourage criminal activity
• Acts that infringe our or a third party’s copyrights, trademarks or other intellectual property rights
• Acts that infringe our or a third party’s property, privacy, portrait rights or other rights or interests
• Acts that defame or slander us or a third party, or damage their honor or credibility
• Entering, sending or providing false information
• Using this site while impersonating another person
• Entering or sending a third party’s name, email address, phone number or other information without that person’s consent
• Using this site’s contact form or other functions to send, in large volume or repeatedly, sales pitches, solicitations, advertising, spam or other information unrelated to the intended purpose
• Sending, providing or using computer viruses or other harmful programs or data
• Placing excessive load on this site, our servers, networks or other systems
• Unauthorized access to this site or our systems, attempts at unauthorized access, probing for vulnerabilities or other acts that harm security
• Reverse engineering, decompiling, disassembling or similar analysis of this site or related systems
• Acts that interfere with, or may interfere with, the operation of this site
• Selling, reselling, distributing or otherwise commercially using information on this site as your own or a third party’s products or services without our permission
• Automated collection, scraping or use for AI or machine learning as set out in Article 5
• Using the name of this site or our company in a way that creates the misunderstanding that a partnership, cooperation, guarantee or other relationship exists between us and a third party
• Providing benefits to antisocial forces or other acts related to antisocial forces
• Acts that directly or indirectly encourage or facilitate any of the above
• Any other act similar to the above that we reasonably judge to hinder the proper operation of this site

4. Intellectual Property Rights

Copyrights, trademarks and other intellectual property rights in the text, articles, explanations, images, photos, charts, illustrations, videos, audio, logos, designs, data and other content posted on or provided through this site (collectively, “Content”) belong to us or to the rightful holders who have licensed us to use them. Being able to view Content on this site does not transfer to users any copyright or other right in the Content, nor grant any use beyond the scope expressly stated in these Terms. Except for private use, lawful quotation and other uses permitted by law, users may not reproduce, republish, modify, adapt, transmit to the public, distribute, sell, publish or otherwise use Content without the prior permission of us or the rights holder. When quoting Content, comply with the Copyright Act and other applicable laws, clearly distinguish the quoted portion from the rest, and indicate the source appropriately. You may not use “AI Minpaku Management,” the name BizPato Inc., logos or other trademarks and service marks shown on this site without the permission of us or the rights holder.

5. Automated Collection, Scraping and Use for AI

Unless we have given prior express permission, we do not permit the use of this site or Content for the following purposes or by the following methods.

• Continuous or large-scale acquisition, collection, copying, storage or analysis using robots, crawlers, scrapers, bots, programs, scripts or other automated means
• Systematically collecting Content to create datasets, databases or similar collections of information
• Using Content to develop, pre-train, further train, fine-tune, evaluate or validate generative AI, large language models, machine learning models or other AI or machine learning systems, or otherwise to improve model performance
• Collecting and storing Content in large volume or systematically for use as the database, search target or information source of retrieval-augmented generation (RAG) or any other system that provides answers, summaries, content or other output to third parties
• Creating or providing services, databases, websites, applications or other services that reproduce all or a substantial part of the Content

Normal crawling and indexing by general search engines for the purpose of providing search results to users is not prohibited by this Article. However, if we give instructions on crawling or similar activity through robots.txt, robots meta tags or other technical means, those instructions must be followed. The fact that this site or Content is publicly available on the internet does not, by itself, mean that we have permitted use for AI or machine learning, large-scale acquisition, scraping or any other use covered by this Article. This Article is not intended to restrict any use that we cannot restrict under applicable law.

6. Information Posted on This Site

We strive to provide appropriate information on this site as of the time it is created, but we do not guarantee its accuracy, completeness, timeliness, usefulness, fitness for a particular purpose, or that it does not infringe third-party rights. Information on this site may differ from actual circumstances due to legal amendments, system changes, market changes, changes to our services or other circumstances after posting. Users must use the information on this site after checking the latest laws, information published by government agencies and other primary sources as necessary.

7. Information on Vacation Rentals and Lodging Businesses

Information on this site about the Private Lodging Business Act, the Hotel Business Act, the National Strategic Special Zone Act, the Building Standards Act, the Fire Services Act, local government ordinances, administrative procedures, taxation and other laws and systems is provided for general informational purposes only. Information on this site does not replace legal, tax, administrative procedure or other professional advice on individual cases from lawyers, administrative scriveners, tax accountants, architects or other professionals. The laws, ordinances, administrative practices and procedures that apply to vacation rental and lodging businesses vary by property location, building use and structure, business format and other circumstances, and may change. When making decisions on notifications, permit applications, business operations or other matters, check with the competent government agency or an appropriate professional as necessary. We do not guarantee that notifications, permits, approvals or other administrative procedures will be completed, or that a particular business can be lawfully started or continued, merely because information on this site was used.

8. Revenue, Fee and Other Simulations

Figures and estimates on this site, such as sales, profit, profit margin, occupancy rate, nightly rate, number of bookings, costs, fee simulations and case studies, are reference information based on certain conditions or past results and do not guarantee future results. Actual sales, profit and other results vary depending on many factors, including the property, location, season, market environment, competition, pricing, operating method, and laws and ordinances. Service details, fees, plans, coverage and other information shown on this site are as of the time of posting and may change later. When you actually use our services, the service details, fees, contract period, payment method, cancellation conditions and other terms of the transaction are as set out in the Individual Contract.

9. Changes, Suspension or Termination of This Site

We may change, suspend or terminate all or part of this site in the following cases and in other cases we deem necessary.

• When performing maintenance, updates or changes to the systems and equipment of this site
• When a failure occurs in communication lines, servers, cloud services or other services provided by third parties
• When a disaster such as fire, power outage, earthquake, typhoon or flood occurs
• When a cyberattack, unauthorized access or other security problem occurs
• When required by laws, requests from government agencies or other reasons
• When we reasonably judge it necessary for the proper operation of this site

Except in emergencies or other unavoidable cases, we will endeavor to give notice, by posting on this site or other appropriate means, of any change, suspension or termination expected to significantly affect users.

10. External Websites and External Services

This site may contain links to websites, social media, booking sites, video services and other external services operated by third parties other than us. External services are provided under the responsibility of their respective operators, and the conditions set by each operator apply to their content, terms of use, security, handling of personal information and other matters. We do not guarantee the content, continued availability, safety, accuracy or other aspects of external services. The presence of a link to an external service on this site does not mean that there is a partnership, endorsement, guarantee or other special relationship between us and the operator of that service.

11. Links to This Site

In principle, ordinary links to this site, whether commercial or non-commercial, may be made without prior notice. However, the following links are prohibited.

• Links from websites containing content that defames or slanders us or a third party, or damages credibility
• Links from websites containing content that violates laws or public order and morals
• Frame links or other links that make this site’s Content appear to be part of the linking website or otherwise mislead users
• Links that create the misunderstanding that a partnership, cooperation, endorsement, guarantee or other relationship exists between us and the linking party
• Any other links that unreasonably harm the credibility, brand or operation of our company or this site

We may request the removal of any link that we reasonably judge falls under the preceding paragraph.

12. Handling of Personal Information

We handle the personal information, personal-related information, information obtained through cookies and other information of users and others that we obtain or handle through this site in accordance with our separately established Privacy Policy.

13. Our Liability

We do not guarantee that this site will be free of system malfunctions, communication failures, unauthorized access by third parties, computer viruses or other problems. We are not liable for damage to users caused by reasons not attributable to us. If damage occurs to a user in connection with the use of this site due to reasons attributable to us, we are liable, to the extent permitted by applicable law, for direct and actual damage that would ordinarily result from those reasons. If damage to a user is caused by our intent or gross negligence, or if laws such as the Consumer Contract Act do not allow our liability to be limited, the limitations of liability in the preceding paragraph and elsewhere in these Terms do not apply to the extent they conflict with such laws. This Article does not change any provision on damages or other liability in an Individual Contract, where one exists.

14. Action Against Violations

If we reasonably judge that a user has violated or is likely to violate these Terms, we may, as necessary, restrict or block that user’s access, delete information sent, request that the act be stopped, or take other necessary measures. If we suffer damage due to a user’s intentional or negligent violation of these Terms or other improper or unlawful acts, we may, in accordance with the law, claim compensation and make other necessary claims against that user. We have no obligation to constantly monitor all acts of use on this site.

15. Changes to These Terms

We may change these Terms when necessary, such as due to legal amendments, changes to the content or functions of this site, or changes in social conditions. When we change these Terms, we will announce the changes and their effective date by posting on this site or other appropriate means. The revised Terms apply from the effective date stated for the change. A change to these Terms does not automatically change the content of an Individual Contract formed before the change. Changes to an Individual Contract follow the provisions of that Individual Contract and applicable laws.

16. Severability

Even if any provision of these Terms, or part of it, is held invalid or unenforceable by law or otherwise, the other provisions of these Terms and the remaining part of that provision remain in effect to the fullest extent possible.

17. Governing Law and Jurisdiction

These Terms and the use of this site are governed by Japanese law. If a dispute arises between us and a user in connection with these Terms or the use of this site, the Tokyo District Court or the Tokyo Summary Court has exclusive jurisdiction as the court of first instance by agreement, unless the law provides otherwise.
